Most work related injuries are covered by the worker’s compensation laws of the state or federal jurisdiction where they occur. At times when the accident is caused during the course of employment as the result of the negligence of a third party, not a fellow coworker usually, then an injury claim may be brought against that offending third party. Typically under Florida law, injuries that occur while going to or from the job area or site are not considered to have occurred during the usual course of employment. However, if the injury occurs while offsite at the request of the employer, then the worker’s compensation laws will apply.
