In spite of the best efforts of the government, OSHA (Occupational Safety and Health Administration), as well as private industry, the construction site represents a very dangerous environment. Each worker is responsible for exercising care on the job and on the construction site. Each worker is also responsible for following all of the safety rules and regulations that are in place. But factor in equipment failure, environmental hazardous, and the negligence of fellow workers, and you have a prescription for potential disaster. Collapsing scaffolds, ladders, and cranes represent equipment failure responsible for serious injury or death to workers on the job. Leaking or spilled chemicals, paints, solvents, and even concrete are examples of product or environmental incidents that injure workers on a fairly regular basis. All of these can lead to disease which are associated with construction work, and could be disabling and in some cases fatal to the worker who contracts them.

The negligence of other employees or third parties on the site is a leading causing of injury on the construction site. If an employee is injured on the job at a construction site the issue of fault is not relevant in a worker compensation claim. Therefore, worker compensation benefits are available to the injured worker regardless of the issue of fault. If the injury is the failure of a third party, not another employee, there may also be a cause of action or a separate personal injury claim which can be brought against that particular party or company as an at-fault party. Furthermore, recovery of damages such as pain and suffering, which are not available in a worker’s compensation claim, may then be sought for construction site injuries in these types of cases.
