Can I Back Out Of A Settlement Agreement?

What if you have agreed to settle your claim, but you change your mind about that settlement? Well, the question of whether a claim was settled or not may in some jurisdictions depend on whether it was an oral settlement or a written settlement.  But in almost ALL settlements, when an individual attempts to withdraw from a previously agreed upon settlement the court will make the determination as to whether the settlement is enforceable. One of the issues that is typically decided in most jurisdictions, is whether or not there was a meeting of the minds when the settlement was agreed to.  Did both parties understand the nature, the extent, and the consequences of the settlement that was entered into?

So, later obtaining information after you’ve agreed to settle the claim that causes you to want to change your mind about that settlement, may not have any effect as to whether that settlement is enforceable.
